As well, dischargeable debts, or those debts where personal liability is taken away by the court system, is more difficult to come by. The Act requires that debtors prove good reason for dischargeable debt and is even requiring more debtors to take responsibility with non-dischargeable debt budgets.

As far as the two major types of bankruptcy laws are concerned, Chapter 13 bankruptcy is that which allows the debtor to keep some assets upon proving only limited debt and a steady income. This bankruptcy is excellent for those debtors who have gotten themselves into major financial difficulty but still have means of paying for some assets. The court will set up a repayment schedule and budget that allows for full repayment of mortgages or cars within three to five years.

If repayment is simply not an option, the bankruptcy law requires that a debtor will file for Chapter 7 bankruptcy. This is often referred to as complete liquidation of assets, except for exempt items. Exempt items in a bankruptcy hearing are determined by the court and are usually items that are a necessity, such as a car or work related items. As well, the courts will distribute debts into two categories: non-dischargeable and dischargeable debt.

Non-dischargeable debts also fall into two categories: non-dischargeable due to wrongful conduct on the debtor and non-dischargeable due to public policy. Wrongful misconduct by the debtor could mean theft or laundering money while public policy could include child support payment or court related judgments.

Keep in mind that in either type of bankruptcy, an individual is almost always required to still pay for taxes, student loans, alimony, child support or court related fees. This is the place where many bankrupt parties are misled in the Chapter 7 bankruptcy, as it is often referred to as "a fresh start". While the court can set up payment plans to help the debtor repay public policy debts, even Chapter 7 debtors will still be required to make payments.

Another major point regarding bankruptcy law is that a bankruptcy will stay on a credit report for approximately ten years. This will make it extremely difficult to become eligible for any type of credit, even a credit card, but especially for a car loan or a house mortgage. While some creditors will still offer limited credit to bankrupt individuals, the interest rates and finance charges are usually through the roof. This makes it even more difficult for debtors to get back on their feet.

Last but not least, keep in mind that bankruptcy law will require any co-signers to be responsible for debt payments. If mom or dad signed for a car loan when you were young and you still owe on that car, they are liable for payments. These friends or family members who were once doing you a favor may be brought into the bankruptcy law court proceedings, which can put a strain on friendships and family relations.

Auto Pagination on Blogger

Latency is a word you hear a lot at Google. We are always looking for ways to make our products faster, because we have consistently found that faster page loads mean more satisfied users. This post is the first of an occasional series that will discuss ways in which we’re working to make blogs load faster for all users.

A few months ago, we took a look at ways to improve the performance of Blogger blogs, and noticed that many pages — particularly search results pages, label pages and archive pages — were taking longer to load than they should.

This has lots of implications. Users suffer — pages take longer to load, and for anyone around the world who pays for their bandwidth, they can incur unnecessary charges as their browser downloads more content than needed. You suffer, because as latency increases, pageviews go down. (See here for a study Google did last year for this phenomenon at google.com.)

Starting today, we’re rolling out a change that affects how we paginate webpages on Blogger. We will dynamically adjust how much content to send to the browser depending on (a) the amount of HTML on the page being requested (in kilobytes) and (b) the number of images on the page. Users can continue to use “older posts” and “newer posts” navigation elements to see additional posts.

For major changes like this, we do incremental roll-outs so we can monitor performance as they progress. We expect the change to be fully deployed over the next week, and once fully deployed, we expect to see several results:

pages will load faster

pageviews, if impacted at all, may increase

We will keep an eye on things, and if we see anything unexpected, we will update this post. Otherwise, keep blogging — and we’ll keep working to make your blog faster for you and your readers!

How the Google Page Creator shutdown may affect your blog

A while back, Google announced that they were shutting down Google Page Creator and offered users the option to upgrade to Google Sites. In the past, some custom template designers used Page Creator to host javascript, a file type that Google Sites does not support. Since a number of bloggers use templates that rely on files hosted on Page Creator, we realized that links to those files would break once the migration from Page Creator to Sites was complete.

Fret not! Rather than see our users' templates break, we built a tool to preserve these links and host the affected files. To find out if your blog is affected, login to your Blogger Dashboard. If we've detected that your blog template contains links to Google Page Creator,

If you see this warning, click Update and review to access the Blogger Template Fixer and correct the links on your blog. (Note: you may not notice any problems with your blog until Page Creator shuts down over the coming days). Visit our Help Center to learn more about fixing your template.

A quick note about music blog removals

Earlier today, word spread about some popular music blogs that were recently removed from Blogger. While we make it a policy to not publicly discuss individual users or their accounts, we wanted to clarify a few things about how and when Blogger enforces its Terms of Service as they relate to our DMCA policy.

Last summer, we updated our enforcement of the DMCA. Our current policy is that when we receive a DMCA complaint, we:

Notify the blogger about the complaint by e-mail and on the Blogger dashboard.

Reset the offending post to 'draft' status, allowing the blogger to remove the offending content.

Send a copy of the complaint to ChillingEffects.org.

When we receive multiple DMCA complaints about the same blog, and have no indication that the offending content is being used in an authorized manner, we will remove the blog.

Inevitably, we occasionally receive DMCA complaints even though the blogger does have the legal right to link to the music in question. Whether this is the result of miscommunication by staff at the record label, or confusion over which MP3s are "official," it happens. If this happens to you, it is imperative that you file a DMCA counter-claim so we know you have the right to the music in question. Otherwise, if we receive multiple DMCA complaints for your blog, this could very well constitute repeat offenses, compelling us to take action.

Update: Should have linked directly to the instructions for filing a counter-notification.

Update 2/11/10: We looked into this issue further and identified one case where a blogger did not receive notification of any DMCA complaints before their blog was removed. We're sorry about this.

We've contacted the blog owner and restored their blog, effective immediately, and we fixed the bug that caused the termination without prior notification. We're also looking into additional preventative protections. We know the DMCA process can be difficult to navigate, and we're working on ways to make this process as smooth as possible.

Create Pages in Blogger

Another top user-requested feature has just graduated from Blogger In Draft! Blogger now makes it easy to create Pages linked from your blog.

This feature lets you easily publish static information on stand-alone pages. For example, you can create an About This Blog page that discusses the evolution of your blog, or a Contact Me page that provides directions, a phone number, and a map to your location.

You create a page similar to how you write a blog post. From Blogger click the Posting | Edit Pages tab, then click New Page. (Note: you can create up to 10 pages.)

Once your page is published, you can link to it from the new Pages widget. The Pages widget lets you add links to your pages as tabs at the top of your blog, or as links in your blog's sidebar.

In the Pages widget, you can decide which pages will be linked and in what order they will appear. You can also choose whether you want new pages to appear automatically in the Pages widget by checking or unchecking the box to the left of Add new Pages by default.

Finally, for those of you that have custom templates, your custom template may not automatically support Pages as horizontal "tabs". If you are familiar with HTML, follow these instructions on how to add Pages to your custom template.

Important Note to FTP Users

Last May, we discussed a number of challenges facing Blogger users who relied on FTP to publish their blogs. FTP remains a significant drain on our ability to improve Blogger: only .5% of active blogs are published via FTP — yet the percentage of our engineering resources devoted to supporting FTP vastly exceeds that. On top of this, critical infrastructure that our FTP support relies on at Google will soon become unavailable, which would require that we completely rewrite the code that handles our FTP processing.

Three years ago we launched Custom Domains to give users the simplicity of Blogger, the scalability of Google hosting, and the flexibility of hosting your blog at your own URL. Last year's post discussed the advantages of custom domains over FTP and addressed a number of reasons users have continued to use FTP publishing. (If you're interested in reading more about Custom Domains, our Help Center has a good overview of how to use them on your blog.) In evaluating the investment needed to continue supporting FTP, we have decided that we could not justify diverting further engineering resources away from building new features for all users.

For that reason, we are announcing today that we will no longer support FTP publishing in Blogger after March 26, 2010. We realize that this will not necessarily be welcome news for some users, and we are committed to making the transition as seamless as possible. To that end:

We are building a migration tool that will walk users through a migration from their current URL to a Blogger-managed URL (either a Custom Domain or a Blogspot URL) that will be available to all users the week of February 22. This tool will handle redirecting traffic from the old URL to the new URL, and will handle the vast majority of situations.

We will be providing a dedicated blog and help documentation to provide as much information as possible to help guide users through the migration off of FTP.
Blogger team members will also be available to answer questions on the forum, comments on the blog, and in a few scheduled conference calls once the tool is released.

We have a number of big releases planned in 2010. While we recognize that this decision will frustrate some users, we look forward to showing you the many great things on the way. Thanks for using Blogger.

New Share Buttons

Sharing is an important feature for bloggers. When your readers find an interesting post, they probably want to share it with other people; this in turn brings more traffic back to your blog.

Blogger now offers new share buttons. The new buttons can be placed under each post and let your blog readers easily share your post via email, Blogger, and popular social networks—we now support Google Buzz, Twitter, and Facebook, and we plan to add more services in the future.

Blogger also has a Share link in the navbar, but for improved convenience you can now have share buttons below the post (we also gave them nice rollover icons). For Twitter, we’ve also integrated the goo.gl URL shortener to give you the maximum space in the Tweet to add your own remarks.

You can start having the new share buttons show up under your posts by editing the Blog Posts widget and enabling Show Share Buttons in Design | Page Elements. Go ahead and turn the new sharing buttons on, and let some fun sharing begin!

Blogger Template Designer Now Available To Everyone

When we launched the Blogger Template Designer to Blogger in Draft in March, you gave us a lot of feedback and suggestions. Our blog post received nearly 1,000 comments and many of you shared your blog’s new looks on Twitter using #newbloggertemplate. Since the launch, we fixed many bugs and added even more themes and background images. But the Blogger Template Designer has only been available on Blogger in Draft, which is why we’re excited to announce that the Blogger Template Designer is now available to everyone.

New Comments System on Blogger

Commenting is one of the most integral parts of blogging: it’s what makes blogging a conversation, not a monologue. That’s why we are pleased to announce two cool new improvements to Blogger’s comments system: much better spam filtering and the ability to view all comments on your blog in one place.

Introducing Comment Spam Filtering

A blog is an open communications system, inviting conversations from all web users. Unfortunately, spammers have been finding their way into these conversations. To fight spam, some of you enabled moderation of all comments or required word verification or login. While somewhat effective, these checks limit real-time conversations around your blog.

To address this, we’ve integrated Google’s spam filtering technologies into the Blogger comment system. Some of you will notice the new “Comments” tab. (Note: We are gradually rolling this out to all users, so some of you may not see the new Comments tab yet.) In the Comments tab, there is a Spam sub-tab that shows all the comments that are likely spam.

The comments in the Spam inbox are not visible to your readers. Here, you can permanently delete spam comments by selecting them and choosing Delete. You can also mark comments as Not Spam that have been incorrectly classified as spam (what we call the “false-positives”). Choose Not Spam and the selected comments will be moved out of the spam list and will be immediately published on your blog.

These feedback actions also help us better identify spam on your blog. We encourage you to occasionally check your Spam inbox to see if any non-spam comments have been marked as spam. Please note that spam filtering currently only applies to new comments.

You can report any issues with our new spam system by clicking on the “Report spam filtering issues” link on the bottom of the Comments | Spam page, or by visiting this Help Forum page.

Comments “Inbox”

We also created a place where you can see all the comments that have been published on your blog. The Comments | Published sub-tab provides a similar view as your email inbox. This view comes in handy when you want to see all of the comments on your blog in one place. With the new comments inbox, it’s easy to find new comments on old posts.

In the Comments | Published sub-tab, you can select comments and mark them as spam or delete them. When you mark a comment as Spam, it will be deleted immediately from your blog. You can also Delete comments for editorial reasons or just Remove Content to leave a record of the comment.

Comment moderation has also moved under the Comments tab and has been extended to allow you to mark comments as Spam.

We hope that adding comment spam filtering and the new “inbox” user interface will be a good starting point toward improving the Blogger commenting system and we look forward to your feedback.

Smart Women Entrepreneurs, Solids, And Fluids

A few weeks ago, our family took a trip to the California Science Center for their 'œfamily lab day.' It was a fun and educational experience. There was one experiment that had to do with the difference between solids and fluids, and it got me thinking about Smart Women entrepreneurs and their businesses. Does your business need to be solid or fluid? Actually, both.

When you first make the decision to become a business owner, you as an entrepreneur are very 'œfluid.' After all, you're probably a solo-entrepreneur trying to do everything yourself! There aren't any rules about how to do anything. The goal is to get some clients and earn an income'”right? After some time passes, you begin to realize that this 'œfluid' aspect of your business is not working. You are 'œsurviving' and you want to be 'œthriving.'

It's time to take a look at where you are in your business now and make a plan for where you want to be in the future. In other words, it's time for a 'œsolid' foundation to be put in place. Your business needs to have a clear plan of action on what you want to accomplish moving forward and how you will accomplish the plan. You will want to gain clarity around how to best market your products and services, gain visibility and produce profit so that your business can 'œthrive.'

Here are a few quick examples of 'œsolid' and 'œfluid' in your business:

Solid '“ I was working with a smart woman just a few weeks ago who has a great concept for her business. The business is growing but at a much slower pace than she'd like. When I asked her what her action plan was for 2010, she didn't really have a clear idea. Her reply was something like, 'œmake money.' This was not a 'œsolid' answer. We spent some focused time exploring her vision for the business this year. We then created a plan around her products and services, her marketing strategy and I also shared some time management solutions to make sure she's getting the 'œright' things done to stay on course

Fluid '“ You need to be open to new ideas and ready to course-correct when necessary. Just yesterday, I was working with a smart woman who's experiencing a lot of frustration around her marketing efforts with little return in terms of new clients. As we explored her business, she soon realized that she had overlooked 2 other streams of income that could generate profits right now in her business with much less effort while she continues to grow this new area of interest.

Working with a coach or mentor can be especially helpful. It provides a grounding process for the woman entrepreneur. It's essential that you take the time periodically to sit down and review the 'œsolid' and 'œfluid' aspect of your business. Is your action plan 'œsolid' for the long-term? Does it have a clear plan of action to gain new clients and produce profit? Do you need to make some changes in your plan? Is it time to course-correct? Many times, we put a plan into action only to find out that we missed a very important piece of information. This is when your thinking needs to become 'œfluid' or flexible with new ideas.

I walked away from the science center that day with more than I expected. Giving yourself permission to get out of your daily routine can open a whole new way of thinking about your life and your business. I invite you to take a look at the 'œsolid' and 'œfluid' parts of your business. It will make a big difference in how it unfolds this year.

What kind of market do these stocks trade in' This is important because some penny stocks trade in exchanges like NASDAQ Small Cap, or the AMEX, which have more regulations and there is more reporting that has to be done with the shareholders.

The over the counter stocks or pink sheet stocks are a little bit less transparent when it comes to their shareholders.

* Does the company have a solid business plan and good financial numbers? Are they profitable or are they losing money? What are their forward looking expectations.

Reports have stated that the antitrust bill is part of House Speaker Nancy Pelosi's (D-CA) strategy of moving smaller pieces of health care legislation quickly to help build momentum for a comprehensive health care reform bill. The Speaker also continues to urge House Democrats to pass the Senate bill as long as it is accompanied by a separate "reconciliation" bill that would 'œfix' key provisions in the Senate bill (e.g., raising the threshold for the Cadillac tax and dropping the Nebraska Medicaid provisions) to satisfy some members of her caucus.

The Senate remained in session last week, despite the weather, although Majority Leader Harry Reid (D-NV) stated that the Senate would not conduct any votes. On Feb. 11, Finance Committee Chairman Max Baucus (D-MT) and Ranking Member Charles Grassley (R-IA) released the highly anticipated 'œjobs bill' '“ The Hiring Incentives to Restore Employment (HIRE) Act.

Senators Baucus and Grassley issued a joint statement, emphasizing that this bill was drafted with bipartisan input. They further stated: 'œWe also agree that, once properly reviewed, the package should be considered in a deliberate, but expeditious manner. Any efforts to needlessly delay Senate completion of consideration of this package through partisan means will undermine our goal of timely action in the current economic climate. Action on the expired provisions is long overdue. Timely action on incentives for economic activity and job creation also is needed.'
Hours after details of the 'œHIRE' legislation were released, Majority Leader Reid publicly stated that he was scrapping the bill. Reid told reporters that when the Senate returns from its recess on Feb. 22, 'œwe will move to a smaller package than has been talked about in the press.' Reid went on to state that some of the tax provisions included in the legislation '“ key to garnering Republican support for the deal '“ 'œconfuse' the bill. Reid went on to say that, 'œwe don't have a jobs bill. We have a jobs agenda.'

The draft 'œHIRE' legislation addresses a number of key health care issues:

* The bill extends, by three months, the eligibility period for premium subsidies for state continuation coverage and COBRA continuation coverage to include persons who are unemployed on or before May 31, 2010. The bill also clarifies that these subsidies are available to persons who are involuntarily terminated from their jobs after previously losing their employer-sponsored coverage due to a reduction in hours. The premium subsidies originally were enacted as part of the American Recovery and Reinvestment Act of 2009, also known as the 'œstimulus bill.'

* The bill provides for a seven-month Medicare physician payment fix (sometimes known as the 'œdoc-fix'), maintaining physician payment rates at their current levels through Sept. 30, 2010. Under current law, in the absence of congressional action, physicians are scheduled to face a steep rate reduction on March 1.

* The bill provides for a one-year extension of both Medicare Advantage Special Needs Plans (section 626) and Medicare Cost Plans (section 627).

* The bill includes numerous provisions addressing Medicare fee-for-service reimbursement issues.
White House Health Care Reform Summit
In a pre-Super Bowl interview on CBS, President Obama said that he would like to host a televised health care summit with Republican and Democratic congressional leaders on Feb. 25. While specific details are not yet available, the summit represents the Obama Administration's latest strategy to jumpstart the health care reform debate and seeks bipartisan cooperation following the loss of the Democrats' supermajority in the Senate. Republican leaders expressed interest in the summit, and House Republican Leader John Boehner (OH) issued a statement saying that, "The best way to start on real, bipartisan reform would be to scrap those bills and focus on the kind of step-by-step improvements that will lower health care costs and expand access." In response, White House officials insisted that the President is not interested in starting from scratch on health reform.

This week Democratic and Republican congressional leaders also met with President Obama at the White House to discuss the jobs bill, health reform, energy, trade and other legislative priorities.

Following the meeting, the President spoke with reporters and he made the following comments about health reform: 'œI'm going to be starting from scratch in the sense that I will be open to any ideas that help promote these goals. What I will not do, what I don't think makes sense and I don't think the American people want to see, would be another year of partisan wrangling around these issues; another six months or eight months or nine months worth of hearings in every single committee in the House and the Senate in which there's a lot of posturing. Let's get the relevant parties together; let's put the best ideas on the table. My hope is that we can find enough overlap that we can say this is the right way to move forward, even if I don't get every single thing that I want
